Court documents were filed June 4. They have a 1 1/2-year-old son, Draco, of whom the 37-year-old actress is asking for joint custody with Verta.
She and Verta tied the knot in La Jolla, Calif., in 2009, after already spending eight years together as a couple. She lists a separation date of June 1.
